The wiretapping without court order violates the illegal search and seizure clause, and the federal legislation which set up the FISA or whatever it is court, which was specifically setup for the purpose of reviewing wiretap requests that the government considered needed to be done secretly. One of the judges for that branch of the court system, who kept his main federal judgeship, resigned this week in protest from the wiretap review court.
